The Delhi High Court on Friday sought a report from the medical board of Lok Nayak Jai Prakash Narayan (LNJP) Hospital on a plea by a married woman seeking termination of her eight-month pregnancy as the fetus was suffering from neurological problems. Justice Pratibha M Singh listed the matter for December 5 and directed the respondent to examine the matter, saying, keeping in view the duration of pregnancy, the Medical Board of LNJP Hospital is directed to examine the petitioner today itself. get the medical examination done and submit a report to this court.
The 26-year-old woman mentioned in the petition that a brain abnormality was detected in the fetus on November 12 and this was confirmed by another ultrasound two days later. However, since the time she conceived, she had done several ultrasounds.
Counsel for the petitioner submitted that in such cases abortion can be permitted under Section 3(2B) and 3(2D) of the Medical Termination of Pregnancy (MTP) Act. The lawyer said, since Guru Teg Bahadur Hospital does not have a medical board for MTP cases, the fetus can be examined by the medical board of LNJP Hospital.
